The Annual Meeting of Landowners & Supervisors of The Central Charlotte County Drainage District was held on Thursday, June 10, 2021, at the Law Offices of Wotitzky, Wotitzky, Ross, McKinley & Young, P.A., 1107 W. Marion Avenue, Unit 111, Punta Gorda, Florida 33950. The meeting was called to order by the president of the District, Mr. David Anthony at 2:00 p.m. Roll was taken, and it was determined that all Supervisors and a quorum of Landowners were present. Landowners and Supervisors who were present at the meeting included David Anthony, Vincent Boccio, and Carol M. Nevling. Also present at the meeting were the District’s Secretary/ Treasurer, Ms. Judy Uhland (via telephone) and the District’s Attorney Mr. Edward L. Wotitzky.

Due and proper Notice of the Meeting was established. Attached to these Minutes is the Publisher’s Affidavit of Publication confirming the Notice of Meeting was published on May 20, 2021, and May 27, 2021.

The Landowners and Supervisors then considered unapproved Minutes. The Minutes of the June 4, 2020, Annual Meeting and December 10, 2020 Workshop Meeting of the District were considered. After review, and on Motion duly made, seconded, and unanimously carried, the Minutes were approved as submitted.

The Landowners then proceeded to elect two (2) Supervisors. The position currently held by Mr. Vincent Boccio and the position currently held by David Anthony were open for election. Mr. Vincent Boccio was nominated to serve an additional one (1) year, and Mr. David Anthony was nominated to serve an additional three (3) year term. There were no other nominations. On Motion duly made, seconded, and carried, Mr. Vincent Boccio was elected to serve as Supervisor for a term of one (1) year commencing on October 1, 2021, and Mr. David Anthony was elected to serve as a Supervisor of the District for a three (3) year term, also commencing on October 1, 2021.

As a result of the election, the following individuals constitute the Supervisors of the District for the noted terms:

The Supervisors then elected officers for terms commencing on October 1, 2021. On Motion duly made, seconded, and unanimously carried, the following individuals were elected to the noted offices:

  • President: David Anthony
  • Vice President: Carol M. Nevling
  • Secretary/Treasurer: Judy Uhland

The financial statements for fiscal year ending September 30, 2020, were then reviewed. Ms. Uhland noted the said financial statements were reviewed by the accountant for the District. After discussion, and on Motion duly made, seconded, and unanimously carried the financial statements for fiscal year ending September 30, 2020, were approved.

The District’s Attorney then reviewed the e-mail dated May 27, 2021, from Kathleen Goodwin, the County MSBU coordinator. A copy of the e-mail is attached to these Minutes. Pursuant to the e-mail, Ms. Goodwin confirmed the Charlotte Ranchettes Street and Drainage MSBU has been abolished, and that a portion of the MSBU Property consisting of lands in the West ¼ of Section 12, Township 41 South, Range 23 East, continue to be within the boundaries of the Central Charlotte County Drainage District. She further advised that the Drainage District can now assess those lands on the Central Charlotte County Drainage District assessment roll if approved by the Supervisors.

The Attorney for the District then reviewed a brief history of the Central Charlotte County Drainage District, commencing with its creation by order of Circuit Court dated January 6, 1966. He noted that when the MSBU was created, the boundaries of the Drainage District were revised to exclude most of the property contained within the MSBU. The above-described property, however, remains within the boundaries of the District even though that property was also included in the MSBU. Pursuant to action taken by the Supervisors at the meeting held on February 24, 2006, the property in Section 12 was released from the assessment obligations of the District, and the MSBU thereupon became responsible for drainage functions. With the abolition of the MSBU, drainage matters involving the West ¼ of Section 12 continue to be within the purview of the Drainage District.

After further discussion, and on Motion duly made, seconded, and unanimously carried, it was

RESOLVED, that the Central Charlotte County District shall include for assessment those properties located in the West ¼ of Section 12, Township 40 South, Range 23 East, Charlotte County, Florida.

Mr. Anthony then advised he would inspect those properties to generally evaluate the current condition of any drainage facilities located on those properties, and report back to the Supervisors at the Workshop Meeting.

The Supervisors then considered the budget for fiscal year commencing October 1, 2021. Ms. Uhland presented two proposed budgets. Proposed budget number one did not include the Section 12 properties, and proposed budget number two included the Section 12 properties. Both proposed budgets also took into account the loss of 63.71 assessment units which were removed from the District’s assessment authority as the properties representing those units had been conveyed to the Development Authority. The Supervisors determined that proposed budget number two, a copy of which is attached to these Minutes should be adopted based upon the inclusion of the Section 12 properties for assessment purposes. After further discussion and review, and on Motion duly made, seconded, and unanimously carried, it was

RESOLVED, that the proposed budget number two for fiscal year commencing October 1, 2021, as presented and attached to these minutes, is approved and adopted. It was further

RESOLVED, that assessments shall be levied at the rate of twenty dollars ($20.00) per acre for fiscal year beginning October 1, 2021, and the assessment roll as written and presented was approved.

The Attorney then advised the Supervisors that due to the abolition of the MSBU and other matters outside the ordinary course of business being encountered by the District, consideration should be given to compensating the Secretary/Treasurer, Judy Uhland for additional work provided to the District. After further discussion, and on Motion duly made, seconded, and unanimously carried, it was
RESOLVED, that the District will compensate Ms. Uhland for additional time based upon invoices presented to the Attorney of the District for review, and to the President of the District, Mr. David Anthony, for approval.

The Attorney then noted that the MSBU Coordinator indicated the District may consider sending notices of the reassessment of the properties of Section 12 for Charlotte County Drainage District non-ad Valorem assessments. A determination of whether notices will be provided to those property owners was tabled for further discussion.

Thereupon, the Workshop Meeting and Supervisors was then scheduled. The Workshop Meeting will be held on Thursday, December 16, 2021, at 2:00 p.m.

There being no further business for the Landowners and Supervisors, the Meeting was, on Motion duly made, seconded, and unanimously carried, adjourned.
